About these terms
These terms are the rules for using Clamber Up, the mastery-learning web app at clamber-up.com. By creating an account or using Clamber Up, the account holder agrees to these terms and to the Privacy Policy.
Who can use Clamber Up
- Accounts are for adults 18 or older: parents or guardians, tutors, and adults who learn with Clamber Up.
- Children use Clamber Up only as climber profiles inside an adult's account. Climbers under 13 may only be added by a parent or guardian, or by a tutor who has a parent's or guardian's permission.
- Clamber Up is available in the United States. It is not currently available in the European Union or the United Kingdom.
Soft launch and approval
Soft launch: anyone can create an account, and we approve each new account before it can start. Clamber Up may decline or delay an account during the soft launch.
The account
- Use a real email address and keep the password private. The account holder is responsible for what happens in the account.
- One adult per account.
- Tell Clamber Up at info@clamber-up.com about any unauthorized use of the account.
Acceptable use
Please use Clamber Up only for learning and teaching. Do not:
- add a climber without the right to do so;
- write names, contact details or other personal information on the scratchpad or in notes, beyond a climber's name or nickname;
- try to reach another account's data, get around the app's limits or security, or disrupt the service;
- copy the lessons or problems in bulk, or use automated tools to collect this content;
- use Clamber Up to harass anyone, or in any way that breaks the law.
Tutors
- A tutor who adds a climber, or works with a climber a parent links, confirms having the permission of the climber's parent or guardian.
- A tutor uses a climber's data only to teach that climber, and keeps notes short, kind and about learning.
- When the tutoring ends, the tutor stops using the climber's data.
- Any agreement about lessons, fees or schedules between a tutor and a family is between the tutor and the family, not with Clamber Up.
Plans, free trial and payment
Clamber Up offers a free trial (currently 14 days) and paid plans for families and for tutors. Prices will be announced. The plan, the price, the billing period and the renewal terms are shown before any purchase.
[Automatic renewal and cancellation terms to be added.] Payments are processed by Stripe.
Cancellation
A paid subscription can be canceled from Plans & billing in the app, or by writing to info@clamber-up.com. [When a cancellation takes effect to be added.] Deleting the account cancels any subscription right away.
Refunds
[Refund policy to be added.]
Content and ownership
- The account holder keeps the rights to what the account adds, such as climber names and tutor notes, and lets Clamber Up store and use it only to run the service as the Privacy Policy describes.
- The lessons, problems, skill map, software, name and logo of Clamber Up belong to the operator. Account holders and climbers may use this content inside the app for learning and teaching.
- Climber data is never sold, and never used to train AI models.
Disclaimers
- Clamber Up is a learning aid. It does not promise any grade, test score or other result, and it does not replace a school or a teacher.
- Clamber Up is provided “as is” and “as available”. It may sometimes be unavailable, and features may change.
- Practice done offline is saved on the device until it syncs. Clamber Up can't recover changes that never reached the account.
Limitation of liability
To the fullest extent the law allows, the operator of Clamber Up is not liable for indirect, incidental or consequential damages, or for lost data or profits, and the total liability for any claim is limited to [limitation amount to be set]. Some places do not allow these limits, so some of these limits may not apply.
Ending the account
- The account holder can stop using Clamber Up at any time, and can delete the account and all of its climbers in Account settings.
- Clamber Up may suspend or close an account that breaks these terms or puts other people at risk, with notice where reasonable.
Governing law
[Governing law and place for disputes to be added.]
Changes to these terms
When these terms change in a way that matters, the version changes, and the app asks every account holder to read and accept the new version before continuing.
